This Rental Agreement must be signed by principal “Renter” ie. individual who holds reservation or booking and/or pays the majority of the rental fee. Renter must be an adult. Hygge Elements, LLC is “Rentee/Releasee.

PRIVATE RENTAL AGREEMENT

By signing this agreement the Renter accepts full responsibility for the care of the equipment they are renting and is responsible for any damage, beyond regular wear and tear, caused by its use. The Renter agrees to pay for any damage to the equipment and to replace the equipment at full retail value if it is lost or stolen.

CANCELLATION POLICY

Mobile Sauna Rental: 2 weeks from the event: 50% cancellation fee, or re-schedule free of charge. 1 week from the event: non-refundable. Bookings within a two week time frame are subject to the policy. Cancellations 3 weeks in advance will receive a full refund.

CHILDREN UNDER THE AGE OF 18 AND ADDITIONAL GUESTS

By signing this agreement, the renter assumes all liability and risk for additional guests. Renter assumes responsibility to ensure every guest signs Hygge Elements LLC waiver prior to use as well as their education on safe use and best practices.
Persons under the age of 18 are not permitted in the sauna

FIRE EXTINGUISHER AND FIRST AID KIT

By signing this agreement, the undersigned acknowledges they are aware of how to use a fire extinguisher and operation using the mnemonic “PASS” (Pull pin, Aim nozzle, Squeeze the trigger, and Sweep over fire).
Fire extinguisher and first aid kit are located in the changing room.

RENTER RESPONSIBILITY

I, the renter, understand/agree that sauna use is inherently risky. I am aware of these risks and that I have read, understood and signed Hygge Elements LLC “RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK WARNING AND INDEMNIFICATION AGREEMENT” prior to use.

I, the renter, understand/agree that I AM RESPONSIBLE FOR ADDITIONAL GUESTS not accounted for by Hygge Elements, LLC at time of booking, and that I assume all risks associated with additional guests using the sauna. I know that the waiver is on the Hygge Elements website and can be accessed and submitted at anytime, along with paper copies in the changing room of the sauna for additional unaccounted guests to read, understand and sign should they choose to participate.

I, the renter, understand/agree that sauna use, heat tolerances and human physiologies vary for every individual and that I have no underlying medical conditions that may disqualify me from sauna use.

RENTAL AND PAYMENT

Rentee shall deliver the Rental to the street address specified by Renter. Renter
grants to Rentee the right to enter the property at the said street address for delivery, and required set up, and for subsequent pick up of the Rental Equipment and any associated equipment at the approximate specified times.

Drop off time will be 1 hour prior to rental delivery. Pickup/breakdown requires approximately 30 minutes post rental. The renter is responsible for all the equipment until it is picked up.

Rentals will not be set up if high flood warnings are in effect, high winds, no one present, not a flat, level area with ample room to maneuver and set up sauna/amenities (sauna is 6ft X 12ft) or any other reason that it will not be a safe rental.

Rentee will provide a briefing and instructions for the equipment and safety.

The rental fee set forth is payable, in full, upon reservation.

COLD PLUNGE RENTAL

The cold plunge requires access to an outdoor water source/connection. Please be aware that when we are packing up the sauna and cold plunge, the water from the plunge will be released where it sits (roughly 75 gallons).

TERMS AND CONDITIONS

Safety/Operating Instructions: in addition to the information set forth in this agreement, the customer acknowledges that there are safety and operating instructions on the equipment/in the sauna studio delivered and agrees to read those instructions and operate the equipment, or allow the equipment to be operated or used, in accordance with those instructions. Renter further acknowledges and understands that Hygge Elements, LLC has not agreed to nor have they provided any operators with this rental, unless previously discussed and agreed to by owner and that customer is solely responsible for the correct and safe operation of the Hygge Elements LLC Sauna Studio.

By entering into this agreement, Renter acknowledges that there is a risk of injury or damage arising out of the use of this equipment. Renter voluntarily agrees to keep and maintain all safety rules for the correct, safe operation and installation and use of all equipment, and to assume all risk of injury or damage. Renter will not permit the equipment to be operated by anyone who is not fully qualified and who has not received instruction from Hygge Elements LLC Staff Member on the safe operation and use of the equipment, nor shall customer allow any person to use or operate the equipment when it needs repair or when it is in an unsafe condition or situation.

GENERAL RELEASE/INDEMNITY/HOLD HARMLESS

Renter will take all necessary precautions regarding the items rented and protect all persons and property from injury or damage. Renter acknowledges that they oversee the operation, and safety of all participants while using the rental. The renter is responsible for its safe operation as well as the return of the Rental in good working order. Renter acknowledges and agrees that Rentee is not responsible for any injury occurring to the renter, or any guests of the renter or to any other persons using the rental or to any claims by any other person(s) injured by or on account of the rental while the equipment is in the possession of the renter and indefinitely. The renter agrees to defend, indemnify and hold harmless Lessor from and against any and all liability, claims, judgments, attorneys fees, and costs, of every kind and nature, including, but not limited to, injuries or death to persons and/or damage to property, whether or not such claimant is known or unknown to renter, which arises out of the use, maintenance, installation, operation, instruction, possession, or rental of any of the rental equipment, however caused, but with such claim arising while or such injury or damage occurring while such Rental Equipment is in the actual or constructive possession of renter. These General Release, indemnity and Hold Harmless provisions apply to, but are not limited to, any injury, death, damage, claim or liability which may arise on account of negligence, whether active or passive.

I, the Renter, voluntarily assume the risk of injury, accident or death which may arise from the use of the sauna and cold plunge studio. I hereby release from all claims or liability for personal injury or damage of any kind. I agree that this waiver is in effect for the entirety of the sauna studio rental and any injuries or effects indefinitely after. I understand that it is my personal responsibility to consult with my doctor regarding participation. I acknowledge, understand and accept the risks inherent in the use of the Hygge Elements, LLC mobile sauna studio.

I, the Renter, hereby acknowledge this release from liability for accidental injury or illness which I may incur as a result of participating in any physical activity. I hereby assume all risks connected therewith and consent to participate. I hereby waive, release, indemnify, hold harmless and forever discharge the owners and staff of (Hygge Elements LLC).

I, the Renter, acknowledge that none of the information provided about the activity is intended to act as a substitute for medical advice, nor does it involve the diagnosis, prescription of remedies or treatment of any disease or ailment. I certify that everything on this form is true and correct to the best of my knowledge. I understand that the sauna, cold plunge or combined cycle is not intended to diagnose, treat, cure or prevent any disease or ailment.

By signing this agreement, you agree that you will abide by all sauna safety placecards/markings.

DO NOT use the sauna under the influence of alcohol, anticoagulants, antihistamines, vasoconstrictors, stimulants, hypnotics, narcotics, tranquilizers or any altering substance. Being in a heated environment in conjunction with consumption of alcohol, drugs or any medication is capable of causing unconsciousness.

Your physician should be consulted before use: espcially if you are pregnant or elderly.

You should NOT use the sauna and cold plunge if you have any underlying medical conditions, heart, lung, or kidney conditions, have had a heart attack, on heart medication, feel ill or unwell, fever, infection, high blood pressure, heat sensitivity, recent tattoo, or open wounds.

Sauna sessions should be limited to a maximum of two hours and not exceeding more than 15 minutes in the sauna at a time. (4 sauna cycles)

Person(s) under the age of 18 are not permitted in the sauna.

Exit immediately and remove yourself if you feel lightheaded, dizzy, out of breath, or heat exhausted.

Please rinse before entering: DO NOT use any lotions, perfumes, make-up or chemicals before you sauna. These products can block pores and perspiration

It is advised to drink water prior to your session and avoid eating two hours prior to your sauna cycle.

Smokers are not permitted in the sauna. Wood surfaces absorb the tobacco odor released from pores when perspiration occurs.

Shoes and jewelry must be removed and left in the changing area before entering the sauna room.

Swim attire, work out shorts and shirt or towel must be worn in the sauna at all times. Do not sit directly on the bench, please sit on a towel.

You are solely responsible for monitoring your body, its function and reaction. You are solely responsible for your safety and well-being while using the sauna and cold plunge. Hygge Elements, LLC and staff are not responsible for any effects, symptoms, or injuriesoccuring indefinitely after your session has been completed.

I acknowledge and understand that Hygge Elements and the staff are not responsible for my action(s) or injuries. Along with any personal items missing or stolen.

I HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THE AGREEMENT AND AGREE TO BE BOUND BY THEM. I FURTHER WARRANT AND REPRESENT THAT I AM EITHER THE RENTER NAMED ABOVE, OR AM AUTHORIZED AND EMPOWERED TO ACCEPT DELIVERY OF THE RENTAL AND TO SIGN THIS AGREEMENT ON THEIR BEHALF AND AS THEIR AGENT. FURTHERMORE, I AGREE THAT I AM ALSO BINDING MYSELF PERSONALLY AS AN ADDITIIONAL PARTY TO ALL TERMS AND CONDITIONS OF THIS AGREEMENT.

I agree and understand that by signing the Electronic Signature Acknowledgment and Consent Form, that all electronic signatures are the legal equivalent of my manual/handwritten signature and I consent to be legally bound to this agreement.
